Terms of Use

1. Acceptance of these Terms

Pick City Sports (the “Service”) is the mobile application of Pick City Football, a football pick’em website operated for private leagues. These Terms of Use (the “Terms”) govern your access to, and use of, the Service. By creating an account, by accepting these Terms within the application, or by otherwise using the Service, you agree to be bound by them. If you do not agree to them, you must not use the Service.

2. Eligibility, and accounts

You must be at least thirteen years of age to use the Service. You may hold one account, you must provide accurate registration information, and you must maintain a current email address, which is used to verify your account, to deliver the notifications that you request, and to communicate with you regarding your account.

You are responsible for maintaining the confidentiality of your credentials, and for all activity conducted through your account. You must notify Pick City Sports promptly if you believe that your account has been accessed without your authorization.

3. No wagering, and no handling of funds

The Service does not accept, hold, transmit, or disburse funds of any kind, and it offers no prizes, no payouts, and no consideration for participation. A league’s dues setting is a record-keeping control, by which a commissioner may note that a member has paid dues that are collected outside of the Service, under arrangements made privately within that league. Pick City Football is not a party to those arrangements, receives no share of them, and accepts no responsibility for them.

You are responsible for ensuring that your participation is permitted by the laws of your jurisdiction.

4. Member content

You retain ownership of the content that you submit to the Service. By submitting content, you grant Pick City Sports a non-exclusive, worldwide, royalty-free license to store, to reproduce, and to display that content to the members of the relevant league, and to retain it as part of that league’s record.

You must not submit any of the following:

• Slurs, harassment, or abuse directed at a person or a group, including abuse based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age.
• Sexual content, and any content that depicts, describes, or sexualizes a minor.
• Threats of violence, incitement to violence, or encouragement of self-harm.
• The private information of another person, including a home address, a telephone number, or a financial detail, published without that person’s consent.
• Spam, fraudulent solicitations, malicious software, and any content that is unlawful, or that infringes the rights of another.

Commentary regarding the picks, the results, and the fortunes of other members is expected, and is permitted. The prohibitions stated above are directed at conduct toward persons, and not at ordinary competitive banter.

Content may be reported, and members may be blocked, from within the application. Reports are reviewed, ordinarily within one business day. Content that violates these Terms may be removed, and the account responsible for it may be suspended or terminated, without prior notice.

5. Automatically generated summaries

The Service may publish a weekly summary of a league’s results that is generated by Claude, an artificial intelligence service operated by Anthropic. Only statistical information is transmitted for that purpose, and entries and members are identified by neutral labels rather than by name. Such summaries may contain errors, omissions, or infelicities of tone. They do not represent the views of Pick City Sports, and they may be reported in the same manner as any other content.

6. Leagues, and commissioners

A league commissioner may remove entries, remove members, enter or amend picks, send email to the members of the league, adjust the settings of the league, and delete the league. Deletion of a league permanently removes its entries, picks, standings, and messages for every member of it. A commissioner acts on behalf of that league, and not on behalf of Pick City Sports.

7. Suspension, and termination

You may delete your account at any time, either from Settings within the application, or at /account/delete-account.php on the website. The Privacy Policy describes what deletion removes, and what it retains.

Pick City Sports may suspend or terminate an account that violates these Terms, that is used for an unlawful purpose, or that presents a risk to other members, to the Service, or to its operation.

8. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without warranty of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Scores, point spreads, schedules, and results are obtained from third parties, and may be inaccurate, incomplete, or delayed. Standings, statistics, and results are provided for the enjoyment of members, and are not warranted to be correct.

9. Limitation of liability

To the fullest extent permitted by applicable law, Pick City Sports shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, nor for any loss of data, of profits, or of goodwill, arising out of or in connection with your use of the Service.

10. Amendment of these Terms

These Terms may be amended from time to time. A material amendment will be published under a new version, and members will be asked to accept that version before submitting further content. Your continued use of the Service following such an amendment constitutes acceptance of it.

11. Governing law

These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict-of-laws principles.
